How to file a European Trademark

This guide will give you an overview about the filing requirements and the application cost for a European Trademark. For more general information please see our article about the European Trademark.

A. FILING REQUIREMENTS

In order to file your EU trademark application, we need the following information and documents:

NAME AND ADRESS OF THE APPLICANT

The application has to be filed in the name of the owner(s) of the mark, either a company or an individual. 

DEPICTION OF THE MARK ("THE DRAWING")

For word marks the desired spelling of the words must be indicated in latin laters (e.g.: POSEIDON)

For graphic trademarks (Logo or so-called “figurative marks”, e.g.) we need a graphic file of the mark, preferable as jpg file.

GOODS AND/OR SERVICES

You must list all specific goods/services for which the EU trademark registration is sought. If you know the international classification number for the goods and services, please also indicate it (e.g. class 09 – computer, computer monitor, notebooks)

POA – POWER OF ATTORNEY

In order to act as the representative of the applicant at the European trademark office (OHIM), we need an authorization. You can use the official PoA form provided by the OHIM to authorize us. Please note that notarization or legalization of the PoA is NOT required. For a quick filing of your trademark applications, you may send us an email with a scanned copy (as pdf file) of the PoA first, the original copy can be sent to us later. The PoA can be given as “General Authorization” so that you won’t have to provide us any further PoA for your subsequent European trademark applications.

OTHERS:

The above information and documents are the basic requirements for filing a European trademark application. Under specific circumstances further documents may be required. For example if you want to claim priority for your trademark, you will have to provide a “priority certificate”.

B. COST

The cost for a European trademark application consists of 2 itmes, the official fee (which are paid to the trademark office) and the attorney fee (which are paid to us as service fee).  The current total filing fee for a standard trademark (up to 3 classes, no priority) via our law firm is 1,400 €, including the official fee of 900 € and our attorney fee of 500 €.  

The above fees may increase under certain conditions (e.g. claiming priority, application for more than 3 classes, etc.).  In case of multiple applications we will offer you a discount on the attorney fee. Please note that for applications filed after May 2009, there is no further registration fee (which were previously 850 €).
